Terms of Service — I'm Here

1. Who you are contracting with

I'm Here (the "Service") is provided by Lindsley Investments LLC ("Lindsley Investments", "we", "us"), trading as I'm Here. These Terms of Service form an agreement between you and Lindsley Investments LLC.

2. Acceptance of these terms

By creating an account or continuing to use the Service, you agree to these terms. If you are using the Service on behalf of an organization, you confirm you have authority to bind it. If you are an individual, you confirm you are of legal age in your jurisdiction. We may update these terms; continued use after an update means you accept the revised terms.

3. What the Service does

I'm Here is a daily safety check-in service. You set a check-in schedule, and if you miss a check-in, the trusted contacts in your Safety Circle can be notified by push notification, email, or (where consented and enabled) SMS. I'm Here is not an emergency service and does not contact 911 or emergency responders.

4. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account.

5. Acceptable use

You must not misuse the Service. In particular, you must not:

use the Service for any unlawful purpose or in violation of any law;
send fraudulent, deceptive, harassing, or unsolicited (spam) messages;
add phone numbers or contact details of people who have not agreed to be contacted;
infringe the intellectual property or privacy rights of others;
interfere with the security or integrity of the Service, including uploading malware, probing or scanning systems, or scraping data;
reverse engineer, resell, redistribute, or circumvent technical limits of the Service.

6. Intellectual property

Lindsley Investments LLC retains all ownership of the Service, including its software, design, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan. Content you submit remains yours; you grant us a limited license to host and process it solely to provide the Service.

7. Service availability and warranties

We work to keep the Service reliable, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. Notifications depend on third parties such as carriers, email providers, and push services and may be delayed or undelivered. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or special damages, including lost profits, lost data, or loss of goodwill. Our total aggregate liability is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including for fraud, death, or personal injury caused by negligence.

9. Subscriptions, payment, and taxes

I'm Here Premium is offered as a monthly or annual subscription. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from Settings or through the customer portal, and you keep access until the end of the period you have paid for. Prices are shown at checkout and applicable taxes may be added.

Payment and billing are processed securely by Stripe. Your card details go directly to Stripe; we never see or store them.

12. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these terms, fail to pay amounts due, create a security or fraud risk, or commit repeated or serious policy violations. Where reasonable, we will give notice and an opportunity to fix the problem. You may stop using the Service and delete your account at any time. On termination, your data is handled as described in our Privacy Policy.

13. Indemnity

You agree to indemnify Lindsley Investments LLC against claims arising from your content, your unlawful use of the Service, or your breach of these terms.

14. Governing law

These terms are governed by the laws of the State of Texas, United States, and the courts of that jurisdiction will have exclusive jurisdiction over disputes, except where mandatory local consumer law provides otherwise.

15. SMS terms

By opting in to SMS notifications, Safety Circle members agree to receive missed check-in notifications from I'm Here.

Message frequency varies. Message and data rates may apply.

Reply STOP to opt out. Reply HELP for help.

SMS consent is optional. A Safety Circle member can accept an invite without enabling SMS.

I'm Here is not an emergency service. If there is an emergency, call 911 or local emergency services.

The I'm Here mobile message service (the "Service") is operated by I'm Here ("I'm Here", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

Consent to receive messages

By consenting to I'm Here's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of I'm Here through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include check-in reminders, missed check-in notifications, and notifications sent to trusted contacts you have added to your Safety Circle. Your consent to receive messages is not required as a condition of purchase.

Message and data rates may apply. Please contact your wireless provider for details of your plan.

Opt-out

You may opt out of the Service at any time. Text the single keyword command STOP to the number that sent you the message to cancel. You will receive a one-time opt-out confirmation message. After that, you will not receive any further messages unless you re-enroll.

Supported carriers

Carriers are not liable for delayed or undelivered messages. The Service is available on most major U.S. carriers.

Not an emergency service

I'm Here is not an emergency service and does not contact 911, emergency responders, or any public-safety answering point. Do not rely on the Service in a life-threatening situation. In an emergency, contact local emergency services directly.

Privacy

For information about how we collect, use, and share your information, please review our Privacy Policy. We do not share SMS opt-in data or phone numbers with third parties or affiliates for marketing purposes.
